Frequently asked questions
How is the hourly rate calculated?
Add salary and fixed allowances, then divide by weekly hours multiplied by 5 (CLT, arts. 59 and 64). A 44-hour week uses 220.
What is the DSR reflection?
Habitual overtime contributes to paid weekly rest: overtime total divided by working days and multiplied by Sundays and holidays (Lei 605/1949; Súmula 172 do TST).
What is the minimum premium?
50% under Constituição, art. 7º, XVI. Sundays or holidays worked without compensatory rest may require double pay under Súmula 146 do TST.
