Off-the-books pay in Brazil: risks for the worker and how to prove it to recover the knock-on effects
Published · Updated
Receiving part of your salary off the books reduces FGTS, INSS, vacation, 13th salary, unemployment insurance and retirement. How to prove unofficial payments and claim the knock-on effects in the Labor Court.

*Off-the-books pay (salário por fora) is the part of pay made without appearing on the payslip — in cash, by Pix or as a separate deposit. It looks advantageous in the short term, but it reduces FGTS, INSS, vacation, 13th salary, unemployment insurance and the retirement amount. If proven, the off-the-books amount is added to salary, and the differences can be claimed in the Labor Court.*
Quick summary
- What it is: regular pay made without appearing on the payslip or work card.
- Losses: FGTS (the Severance Indemnity Fund), the 40% penalty, INSS (social security), vacation + 1/3, 13th salary, overtime, unemployment insurance and retirement calculated too low.
- In court: the amount can be added to salary, with all knock-on effects.
- Evidence: bank statements, Pix receipts, messages, spreadsheets and witnesses.
- For the employer: evasion of taxes and contributions.
How much you lose, on average
Example: registered salary of R$ 2,000 and R$ 1,000 off the books, for 3 years.
- Undeposited FGTS: 8% × R$ 1,000 × 36 months ≈ R$ 2,880, not counting the 40% penalty.
- 13th salary and vacation calculated on R$ 2,000 instead of R$ 3,000.
- INSS underpaid, reducing future benefits.
How to prove it
- Bank statements with regular monthly transfers outside the payslip.
- Pix receipts, informal receipts and annotated envelopes.
- Messages about the agreed amount.
- Witnesses who were paid the same way.
- Job ad or offer with an amount different from the registered one.
Points to watch
- Commissions and bonuses paid off the books also count — see Commissioned salespeople.
- Profit sharing paid monthly may be considered disguised salary — see Profit sharing.
- The deadline to claim is 2 years after the end of the contract, covering the last 5 years.
Frequently asked questions
I agreed to be paid off the books. Can I claim later?
Yes. Adding the amount to salary is a right, and the informal agreement does not remove the knock-on effects.
Is the worker also penalized?
Responsibility for contributions lies with the employer. The worker can claim the differences.
