Working without a registered contract in Brazil: rights and how to regularize
Published · Updated
Anyone working without registration has all CLT rights if there is an employment relationship. The registration deadline, the employer's fine, how to prove it and how to claim.

*Anyone who works personally, regularly, under subordination and for pay is an employee, even without a registered work card (carteira assinada). The employer must register the contract within 5 business days; if it does not, the worker can ask the court to recognize the employment relationship and all rights for the period.*
Quick summary
- Registration deadline: up to 5 business days after hiring (CLT, art. 29 — the CLT is Brazil's Consolidated Labor Laws).
- Fine for the employer: R$ 3,000 per unregistered employee (R$ 800 for micro and small businesses) — art. 47.
- Rights for the period: vacation + 1/3, 13th salary, FGTS (the Severance Indemnity Fund) + penalty, overtime, severance pay and contribution time with the INSS (social security).
- Deadline to claim: up to 2 years after the end of the relationship, covering the last 5 years.

Ways to regularize
- Ask the employer in writing to register you.
- Report the lack of registration to the Ministry of Labor through gov.br — the inspection can issue a violation notice to the company.
- File a labor claim asking for recognition of the employment relationship and the amounts owed — even without a lawyer, through jus postulandi.
