Itamaraty says Brazil has no official notification of precautionary measure MC-537-26 at the IACHR

On 08/21/2026, the MRE Human Rights Division answered on Fala.BR that there is no record of official notification to the Brazilian State about MC-537-26. What the document says, what the IACHR usually does before deciding, and what the answer does not address.

On 08/21/2026, the Human Rights Division (DCDH) of Brazil's Ministry of Foreign Affairs (MRE) stated, in reply to a request filed through Fala.BR, that "there is no record, to date, of official notification to the Brazilian State" about Precautionary Measures Request MC-537-26 before the Inter-American Commission on Human Rights (IACHR).

It is the first formal statement by Itamaraty on the proceeding. It fixes what the Brazilian State had on record on that date, and that is all it fixes.

1. The request to Itamaraty

On 07/28/2026, the complainant filed NUP 09002.002192/2026-91 on Fala.BR, addressed to the Minister of Foreign Affairs and the heads of the Human Rights and Social Affairs departments. The request set out the proceedings under way in Brazil and abroad and asked for:

  • analysis of the case by the Secretariat for Political Multilateral Affairs (SAMP);
  • coordination with the Federal Prosecutor General's Office and the Attorney General's Office on Brazil's obligations in the Inter-American System;
  • the Ministry's official position and the channels through which it follows the case, including in bilateral relations with France and the United Kingdom.

2. What the MRE answered

The Foreign Service Ombudsman forwarded the request to SAMP, and the conclusive answer is dated 08/21/2026. It reproduces the DCDH statement, which records three points:

  • the DCDH delimited its remit: it can speak "only" to the passage mentioning precautionary measure MC-537-26;
  • the IACHR document attached to the request is described as a communication from the Commission "addressed to the requester himself, asking for additional information" for an eventual decision on the precautionary measures;
  • there is no record of official notification to the Brazilian State about the opening or progress of the proceeding, and therefore "there are no measures to be taken" by the Division at that time.

The DCDH adds that, if official notification arrives, the Ministry will take the appropriate measures in coordination with the competent national bodies.

3. What the absence of notification means

The MRE cites Article 25 of the IACHR Rules of Procedure. Under Article 25.5, before deciding on a request for precautionary measures, the Commission as a rule asks the State concerned for information. Prior consultation is waived only when the imminence of the harm does not allow delay.

Two facts appear in the MRE's own document: the Commission wrote to the complainant asking for additional information, and the State had no notification on record on 08/21/2026. Both are compatible with a proceeding still at the stage of assessing the request, before any request for information to the State. The answer does not say so, and Human Case does not assert what the IACHR will do.

4. What the answer does not address

The DCDH answered only within its remit. The text does not mention the other points of the request: the Ministry's assessment of the implications of the case, coordination with the Prosecutor General's Office and the Attorney General's Office, and the follow-up channels in relations with France and the United Kingdom.

It also does not say how the Division verified that no notification exists, or whether the inquiry reached Brazil's Mission to the OAS.

5. Questions the MRE has not answered

  • Which area of the Ministry is responsible for the points of the request that the DCDH did not address?
  • Did the DCDH's verification include Brazil's Mission to the Organization of American States?
  • Is there an internal procedure to follow the case before any formal notification?
  • Is there a coordination guideline with the Prosecutor General's Office and the Attorney General's Office in case the IACHR notifies Brazil?

6. Next steps

The answer is dated 08/21/2026. Human Case has no information on any notification to the Brazilian State after that date, and any new fact about MC-537-26 will go into a new post on the date it occurs. The proceeding remains under analysis at the IACHR, as recorded in earlier posts.

What the MRE document contains is what the Ministry had on record on 08/21/2026. This is Human Case's reading, published in the exercise of freedom of expression (Constitution, art. 5, IV and IX) and based on the documents listed below.
