Frequently asked questions
How much FGTS does the employer deposit each month?
8% of remuneration each month, including 13th salary, vacation pay and overtime; for apprentices, 2% (Lei 8.036/1990, art. 15).
Is the fine based on the current balance or all deposits?
It is based on all contract deposits with adjustments, including amounts already withdrawn — Lei 8.036/1990, art. 18, §1º.
Do birthday-withdrawal participants receive the fine?
Yes. The fine is released for dismissal without cause, but the balance remains blocked for termination withdrawal under the applicable rules.
What is the deadline to deposit the fine?
Up to 10 days after the contract ends — CLT, art. 477, §6º.
What if the employer has not deposited FGTS?
Report it to the Ministry of Labor and claim it in the Labor Court. You have 2 years after leaving to claim the preceding 5 years.
Do domestic workers receive a 40% fine?
No. Compensatory payments of 3.2% are deposited monthly in a separate account — LC 150/2015, art. 22.
How FGTS is calculated
8% of salary each month (2% for apprentices), also on 13th salary, vacation pay and overtime. Interest is 3% a year + TR + profit distribution. Check deposits in the FGTS app.
How the fine is calculated
40% of all adjusted contract deposits, including prior withdrawals; 20% for agreement, mutual fault and force majeure; no fine for resignation, dismissal for cause or fixed-term expiry.
