Justification of the temporary contract: what Law 6.019 requires and the three versions of the same field
Law 6.019 only authorizes temporary work in two cases and requires a written contract stating a justifying reason. A complete guide: contract requirements, where the reason is declared, how to check it and the three versions in the Pernod Ricard case.
Temporary work is an exception to the indefinite-term employment contract. That is why Law 6.019/1974 requires the reason to be stated in writing, before the service is provided. When the reason changes depending on the document, the validity of the regime comes into question. This guide explains the permitted cases, what the contract must contain, where the reason is declared and how to check consistency among the versions.
1. Direct answer
Temporary work is only permitted for the temporary replacement of permanent staff or for complementary demand for services (Law 6.019/1974, art. 2). The contract between the temporary-work agency and the client company must be written and state the reason justifying the demand (art. 9, II). A divergence between the reason in the contract, the reason declared to eSocial and the reason alleged in a defense is an indication that deserves investigation.
2. Legal basis
- Art. 2: defines temporary work as that provided by an individual hired by a temporary-work agency that places them at the disposal of a client company, to meet the need for temporary replacement of permanent staff or complementary demand for services. Complementary demand is that arising from unforeseeable factors or, when arising from foreseeable factors, of an intermittent, periodic or seasonal nature.
- Art. 4: requires that the temporary-work agency be a legal entity registered with the Ministry of Labor and Employment.
- Art. 9: the contract between the companies shall be written, available to the inspectorate, and contain the identification of the parties, the reason justifying the demand, the term of the service provision and the amount.
- Art. 9, §3: the temporary employment contract may cover support activities and core activities.
- Art. 10: maximum term of 180 days, consecutive or not, extendable by up to 90 days when the conditions that gave rise to the hiring are shown to persist.
- Art. 12: rights of the temporary worker, such as pay equivalent to that of the client company's employees.
- Decree 10.060/2019: regulates the law.
3. The two permitted cases
Temporary replacement of permanent staff. The reason is the temporary absence of an employee of the client company: leave, vacation, time off. To be verifiable, the contract must state which position or department the replacement refers to.
Complementary demand for services. The reason is an increase in work that cannot be met by the regular team: an unforeseeable peak, seasonality, a project with an end date. To be verifiable, the contract must state the nature of the demand and its relation to the contracted period.
Generic wording ("company need", "market demand") tends to be challenged because it does not allow verification.
4. What the justification must contain
- Which of the two cases applies.
- A concrete description of the need: who is replaced or what the demand is.
- Temporal consistency: the term must match the reason (replacement ends when the replaced person returns; demand, when it ends).
- Correct identification of the parties: who hires (the ETT) and who receives the service.
- Compatibility with the statutory term of 180 days, extendable by 90 more.
5. Where the reason is declared
The reason usually appears in four places, and all must be consistent:
- The worker's individual contract.
- The inter-company contract between the ETT and the client company (art. 9).
- eSocial, in the admission (S-2200) and dismissal (S-2299) events.
- The defense, when the regime is challenged in court.
In answers to freedom-of-information requests, the Ministry of Labor and Employment stated that eSocial does not validate the reason declared for the temporary hiring. That is, the system accepts any text, and checking is done by the worker, the inspectorate or the court.
6. How to check the justification, step by step
- Ask for a copy of the individual contract and the inter-company contract.
- Compare the reason declared in the two documents.
- Check the reason declared to eSocial (through the CNIS extract or admission documents).
- Check whether the case makes sense: who was replaced, what the demand is and the period.
- Check the temporary-work agency's registration (see the post on ETT and SIRETT).
- Check the total term and any extensions.
- If there is a divergence, record it in writing and ask for clarification.
7. Consequences of an invalid justification
When the reason does not exist, is generic or is contradictory, the legal debate is about the validity of the temporary regime. In general terms, the argument is that, without meeting the legal requirements, there is no regular temporary work, and the ordinary rules of the employment contract come under examination. The result depends on the evidence and on the court in the concrete case, and there is no single solution. It is important not to presume the outcome.
8. The three versions in the Pernod Ricard, Michael Page and Page Interim case
In the dossier documents, the reason for the claimant's hiring by Page Interim, to work at Pernod Ricard Brasil, appears in three versions:
- "Complementary demand" in the individual contract.
- "Support for the new strategic brand positioning campaigns" in eSocial.
- Replacement for maternity leave in the defense.
Instrument ID c28562b, filed by Pernod Ricard as the contract of the temporary regime, is an RPO (recruitment, CNAE 78.10-8) contract, signed by Michael Page International and Page Personnel, and not the temporary labor supply contract (CNAE 78.20-5) required by art. 9. The contracted party only added "temporary labor supply" to its corporate purpose on 02/10/2025 (JUCESP) and only obtained SIRETT registration on 20/05/2026, dates after the claimant's contract.
The MTE, in answers to freedom-of-information requests, stated that "the designation RPO, by itself, neither replaces nor removes the legal requirements applicable to hiring temporary work" and that "the participation of companies from the same economic group does not dispense with identifying the contracting parties". The subject is part of Civil Inquiry no. 005856.2026.02.000/1 of the MPT and case no. 1000293-10.2026.5.02.0050.
9. Frequently asked questions
Is a generic reason valid? The law requires a justifying reason. The level of detail required is discussed case by case.
Can temporary workers be used for core activities? Yes, the law allows support and core activities (art. 9, §3), but a reason is still needed.
Can I ask for the inter-company contract? The worker has an interest in checking it. The labor inspectorate is guaranteed access, and in court its filing may be requested.
What is RPO? Recruitment Process Outsourcing, the outsourcing of the recruitment process. It is a different service from supplying temporary labor.
What if the term exceeds 180 days? The law allows extension by up to 90 days, under specific conditions. Beyond that, regularity is questioned.
Practical cases and advanced questions
Hypothetical example 1: a replacement that does not exist. The contract says "replacement of an employee on leave", but does not say who is replaced nor the department. Without these data, the justification is not verifiable. The inspectorate may ask the client company to prove the leave, and the worker may ask for clarification in writing.
Hypothetical example 2: seasonal demand without seasonality. The contract indicates "complementary demand due to seasonality", but the activity is continuous throughout the year. The question is whether the need is intermittent, periodic or seasonal in nature, as art. 2, §2 requires, or whether it corresponds to a permanent post.
Hypothetical example 3: extension without reason. The 180-day contract is extended by 90 more days without proof that the conditions that gave rise to it persist. The extension requires that proof (art. 10, §2).
Question: does the reason in eSocial have to equal the one in the contract? The law does not mention eSocial, but consistency among documents is an indication of regularity, and divergence is an indication of a problem. The MTE reported that the system does not validate the reason, so checking is human.
Question: who proves the regularity of the reason? As a rule, whoever relies on the exceptional regime, that is, the company. The worker bears the burden of showing the facts alleged, but the company's possession of the documents influences the allocation of proof.
Question: does a core activity prevent temporary work? No. Art. 9, §3 allows support and core activities. What the law requires is a temporary reason.
