Precautionary measures at the IACHR: how long they take and what they require
The IACHR may grant precautionary measures in cases of gravity, urgency and risk of irreparable harm. A complete guide: requirements, procedure, difference from the petition, deadlines, what to submit and the example of MC-537-26.
The Inter-American Commission on Human Rights (IACHR), a body of the Organization of American States (OAS), has two instruments that are often confused: the precautionary measure, which protects against an immediate risk, and the individual petition, which seeks examination of a violation that has already occurred. Each follows its own procedure, with different requirements and deadlines. Understanding the difference is the first step to choosing the right path and not expecting from the precautionary measure what only the petition delivers.
1. Direct answer
A precautionary measure requires three elements: gravity of the situation, urgency and risk of irreparable harm to persons. The IACHR analyzes requests in order of arrival and usually asks the requester and the State for additional information before deciding. There is no fixed analysis period, and the decision does not judge the merits: it asks the State to adopt measures to prevent the harm.
2. Normative basis
- American Convention on Human Rights (Pact of San José): Brazil is a party. The IACHR's competence for petitions is in arts. 44 to 51.
- IACHR Rules of Procedure, art. 25: regulates precautionary measures. The IACHR may grant them on its own initiative or on request, considering gravity, urgency and irreparable harm. Before deciding, as a rule, it requests information from the State, except in extreme urgency.
- IACHR Rules of Procedure, art. 23 and following: govern petitions, with admissibility requirements, such as exhaustion of domestic remedies (Convention, art. 46.1.a) and submission within six months of the final decision (art. 46.1.b), with exceptions (art. 46.2).
- IACHR Rules of Procedure, art. 76 and following: deal with provisional measures, which the Commission may request from the Inter-American Court when the precautionary measure is not complied with.
3. Precautionary measure × petition
- Purpose: Precautionary measure = prevent irreparable harm; Petition = examine violation of rights
- Core requirement: Precautionary measure = gravity, urgency, imminent risk; Petition = exhaustion of domestic remedies
- Procedure: Precautionary measure = information to the State and decision; Petition = admissibility and then merits
- Result: Precautionary measure = request to the State to adopt measures; Petition = report with recommendations
- Duration: Precautionary measure = variable, due to urgency; Petition = generally, years
They are autonomous procedures. The IACHR may analyze one and not the other, and the decision on one does not bind the other.
4. The three requirements, in detail
Gravity: the situation must involve a serious threat to the right to life or personal integrity, or to another right of equal weight. Generic allegations or those of a merely financial nature are usually insufficient.
Urgency: the risk must be present or imminent, so that delay in deciding would harm protection. Past facts, without present risk, are not enough.
Irreparable harm: the harm cannot be repaired later by compensation or another form. Loss of life, serious damage to health and harm to integrity are typical examples.
The IACHR also considers whether the person at risk is identified or identifiable, and whether the State was informed of the risk and had the opportunity to act.
5. How it works in practice
- The requester submits the request with identification of the persons at risk, a description of the facts and documents.
- The IACHR confirms receipt and assigns a number (MC).
- It may request additional information from the requester.
- It may request information from the State, with a deadline to answer.
- It decides to grant, expand, keep under analysis or close.
- Once the measure is granted, the State must report on the measures taken, and the IACHR follows up on compliance.
6. What to submit
- Full identification of the person at risk (name, nationality, location).
- A chronological description of the current risk.
- An indication of what has already been asked of national authorities and the answers.
- Medical documents, official letters, decisions, protocols.
- What is requested of the State (for example, ensuring access to treatment).
- Supervening information, whenever there is a new fact.
Respond quickly to any request for additional information, because deadlines are short.
7. Common mistakes
- Requesting a precautionary measure to repair harm already done.
- Not showing the current risk.
- Mixing merits requests and immediate-protection requests in the same petition.
- Failing to update the IACHR.
- Expecting an immediate answer: the analysis queue is chronological.
8. In the Pernod Ricard, Michael Page and Page Interim case
On 26/03/2026, the claimant submitted a petition to the IACHR (no. 0000110936), followed by supervening information. Precautionary Measure MC-537-26 and petition P-773-26 run as separate procedures.
- 09/04/2026: the IACHR requested additional information from the claimant in MC-537-26.
- 18/08/2026: the IACHR reported that requests are analyzed in chronological order.
- 03/09/2026: MC-537-26 remained under analysis.
- 23/09/2026: the Federal Public Defender's Office examined the claimant's request for representation before the IACHR (Report no. 9254595).
The dossier records, in a communication to the Brazilian NCP of 08/04/2026, the link between the non-payment of severance and the interruption of the claimant's treatment, who lives with a chronic illness. The amounts arise from the temporary contract with Page Interim, working at Pernod Ricard Brasil.
9. Frequently asked questions
Is a precautionary measure a conviction? No. It is a request for protection addressed to the State, without judgment of the merits.
Do I need a lawyer? It is not mandatory to submit the request, but it helps.
How long does it take? It varies with urgency and the analysis queue.
Does the precautionary measure replace the lawsuit in the Brazilian courts? No. National proceedings follow their course.
What happens if the State does not comply? The IACHR may request provisional measures from the Inter-American Court.
Practical cases and advanced questions
Hypothetical example 1: health risk. A person with a chronic illness interrupts treatment for lack of resources, after an employer fails to pay amounts due. The request for a precautionary measure must show the current risk (the interruption under way), the medical report, attempts to access treatment through the public system and what is requested of the State.
Hypothetical example 2: harm already done. If the harm has already occurred (for example, loss of a job years ago, with no current risk), the precautionary measure tends not to be the appropriate instrument, and the route is the petition, which examines past violations.
Hypothetical example 3: new facts. After the request is submitted, the situation worsens. The requester must send supervening information, stating the number of the precautionary measure and the new documents.
Question: is the State heard? As a rule, yes. The IACHR requests information from the State, except in cases of extreme urgency.
Question: does the precautionary measure suspend cases in Brazil? No. It asks the State to adopt protective measures. National cases follow their course.
Question: what is the relationship with the Inter-American Court? If the State does not comply with the measures, the Commission may request provisional measures from the Court, which are binding on States that accept its jurisdiction, such as Brazil.
Question: can I file a precautionary request and a petition at the same time? Yes. They are autonomous procedures, with their own numbers, and can be submitted in parallel.
