Frequently asked questions
Who is entitled to proportional notice?
The proportional increase benefits an employee dismissed by the employer; it does not increase notice owed on resignation.
Can I reduce my hours during worked notice?
On employer dismissal, choose 2 fewer hours each day or 7 consecutive days off, without loss of pay (CLT art. 488).
Does the projected date count toward other rights?
Yes. Employer-compensated notice counts toward service under CLT art. 487, §1º.
How the calculation works
For employer dismissal, we reuse proportional notice: 30 days + 3 per completed year, capped at 90 (Lei 12.506/2011). Pay = (salary + average variable pay) ÷ 30 × days. We exclude the communication date and add notice days for the projected end date. Projection counts toward service for 13th salary, vacation and FGTS (CLT art. 487, §1º). Worked notice is up to 30 days, with the proportional excess compensated. On resignation, notice is 30 days; not working it may lead to a deduction (art. 487, §2º).
