Bathroom breaks at work in Brazil: can the employer control them?
Published · Updated
An employer cannot restrict or condition bathroom use in a way that humiliates employees. Abusive restriction leads to moral damages. What case law says.

An employer may organize work, but cannot prevent, limit the number of, time in a humiliating way or punish bathroom visits. The Labor Courts treat such restrictions as a breach of dignity and often order the employer to pay moral damages. In call centers, NR-17 guarantees leaving the workstation at any time for physiological needs.
Quick summary
- Forbidden: limiting the number of visits, demanding humiliating justification, exposing the employee or docking the time.
- Allowed: organizing cover so the post is not left empty, without preventing the break.
- Call centers: NR-17 ensures leaving the workstation at any time for physiological needs.
- Facilities: NR-24 requires adequate toilets in sufficient numbers.
- Consequence: moral damages and possible constructive dismissal.
