Bank employees in Brazil: the 6-hour day and positions of trust
Published · Updated
Bank employees have a 6-hour workday (CLT art. 224). Those in positions of trust with a 1/3 bonus may work 8 hours. When overtime is owed.

Bank employees have a 6-hour day and a 30-hour week (CLT, art. 224). The exception is those in positions of trust, such as managers and supervisors, who receive a bonus of at least 1/3 of their salary: their day can be 8 hours (art. 224, § 2). If the position is one of trust in name only, the 7th and 8th hours are owed as overtime.
Quick summary
- Rule: 6 hours a day, Monday to Friday.
- Position of trust: 8 hours, with a minimum bonus of 1/3 of salary.
- Branch general manager: may have no hours control (art. 62, II, and Precedent 287).
- "Trust" in name only: without real management powers, the 7th and 8th hours are overtime.
- Who counts as a bank employee: staff of banks and banking houses; finance companies are treated alike (Precedent 55).
What makes a position one of trust
The job title is not enough. There must be special trust, such as leading a team, authority to approve transactions or access to confidential information, plus the 1/3 bonus. An analyst, teller or assistant titled "relationship manager" without management powers is usually owed overtime.
How to calculate overtime
For the 7th and 8th hours, the hourly rate is salary divided by the applicable divisor, with a 50% premium or the one in the category's agreement. The TST set divisors of 180 (6-hour day) and 220 (8-hour day).
Frequently asked questions
Is Saturday a working day for bank employees?
No. TST Precedent 113 treats a bank employee's Saturday as a non-worked business day, with no overtime reflection.
I work at a finance company. Do I have a 6-hour day?
Finance company employees are treated as bank employees for working hours (TST Precedent 55).
Does the 1/3 bonus offset overtime?
Not if the position is not truly one of trust. In that case overtime is owed, and the bonus only pays for the greater responsibility.
